OVERVIEW

This website is operated by STONE COAST SERVICES CORP (“Company”). Throughout the site, the terms “we,” “us,” and “our,” refer to the Company. We offer this website, including all information, tools, services, programs, and other content available on this site to you, the user, conditioned upon your acceptance of all the terms, conditions, policies, and notices stated in these Terms of Service (hereinafter, the “Terms”).

Please read these Terms carefully before accessing or using our website. Your access to and use of the site, our programs, and our services is conditioned upon your compliance with these Terms. These Terms apply to all visitors, users, registrants, and others who wish to access or use our site, programs, or services. The headings used in these Terms are included for convenience only and shall not limit or otherwise affect these Terms.

By accessing or using any part of the site, our programs, or our services, you agree to be bound by these Terms. If you do not agree to any or all of the terms and conditions set forth in these Terms, you do not have permission to access the site or use our services or programs.

DISCLAIMER

The programs, diplomas and certificates we offer do not constitute accredited high school courses or replacements for a “traditional” high school diploma. We do not test you for or issue a General Educational Development exam (“GED”).

MILITARY REQUIREMENTS

You understand that the programs, courses, diplomas, and certificates offered by us do not guarantee qualification for military enlistment. Please contact a military recruiter prior to registering with us.

COLLEGE REQUIREMENTS AND JOB ACCEPTANCE

You understand that the programs, courses, diplomas and certificates offered by us do not guarantee eligibility for college admission. Each college program has its own set of admissions requirements. Contact the admissions office of your college of choice prior to registering with us. You understand that job acceptance is at the sole discretion and choice of the employer. You assume and accept full responsibility for your actions, including your misuse or misrepresentation of a diploma, certificate or other document we issue to you.

REGISTRATION AND ACCOUNTS
Registration is required in order to use or access our programs and services. During the registration process, you will be required to provide certain information about yourself. You will also be required to choose an email and password (“Login Credentials”). Your Login Credentials are personal and must be kept strictly confidential at all times.

Your Login Credentials may not be disclosed to any third party and you are solely responsible for (a) maintaining the confidentiality of Login Credentials, and (b) any activity that occurs under or through your Login Credentials, whether or not such activity has been authorized. Remember to sign out of your account and close your browser window once you have finished your work, in order to ensure security of your data. If you believe the confidentiality of your Login Credentials has been compromised or violated, please notify us immediately via email at [info@stonecoastacademy.com] or telephone [305-704-7827] and we will deactivate your account as soon as possible. However, you remain liable for any authorized or unauthorized activity that occurs under your Login Credentials until your account is deactivated.

REQUIREMENTS

You may register on our site by completing the applicable registration form provided that you are 18 years old or older. You represent and warrant that you are 18 years old or older.

You represent that neither you nor any associated person is a journalist or media professional acting in that capacity or that neither you nor any associated person is using our services to obtain an award or awards or to publish a news story or article of any sort in any media whatsoever, specifically including but not limited to printed matter, books, magazines, journals, newspapers, television, radio, multimedia, Internet, websites, Chat Rooms, Newsgroups, Forums, Usenet, telephone, mobile telephone, Wireless Access Protocol, FAX (facsimile transmissions) or emails.

PROGRAM SUSPENSION

We offer a three-month program. You have three months from your registration date to complete the program. After three months, your account will be suspended, and you will need to discuss your future options with our administrator. After three months, there are no refunds.

RIGHT TO TERMINATE ACCOUNT – CHEATING AND PLAGIARISM

In addition to other prohibitions as set forth in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of our services or of the site, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; (k) to impersonate any person or entity or misrepresent your identity; (l) to interfere with or circumvent the security features of the site or any related website, other websites, or the Internet; or (m) to engage in any other conduct which we, in our sole discretion, determine to be inappropriate or unacceptable. We reserve the right to terminate your use of the site or any related website for committing any of the prohibited uses.

We have the right to suspend or terminate your account and refuse any and all current or future use of our service(s) (or any portion thereof) if we have reasonable grounds to suspect any of our terms have been violated through cheating, plagiarism, submission of non-original work, or other unethical or illegal activity. Certain violations, including but not limited to misuse of exam materials, cheating, and violations of copyright and trademark laws, may also result in civil and/or criminal liability.

In addition, all materials available on or through our site, including all of the trademarks on such materials, are protected by United States and international laws and treaties protecting copyright and trademarks, and are provided to you as part of the program in which you have enrolled solely for your personal use in the associated program. You are not authorized to copy, re-sell, use, reproduce, duplicate, share, download, or transmit any materials for any commercial purposes or for use on behalf of any third parties.

PERSONAL INFORMATION AND CREDIT CARD INFORMATION

The only personal information we collect is information you choose to supply. By enrolling with us, you may be asked to supply certain information relevant to your purchase, including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and (ii) the information you supply is true, correct, and complete. We may employ the use of third-party services for the purpose of facilitating payment and the completion of purchases. By submitting your information, you grant us the right to provide the information to these third parties. You warrant to us that the credit card information that you provide us is correct and is your account. You may not use the billing information or identity of another person or entity without their proper prior authorization. We do not store your credit card information.

You agree to provide current, complete, and accurate purchase and account information for enrollment. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates in order for your transaction to be completed. Inaccurate, incomplete, or obsolete information may result in the immediate suspension or termination of your account. You may not use the billing information or identity of another person or entity without proper prior authorization. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion without notice.

We may also collect non-personally identifiable information. This information may include, for example, computer and server IP addresses, browser versions, referring websites, search terms used, pages most visited, duration and time of visit, and geographic location. This information is collected and stored automatically to track website usage, but this information is not directly linked to you personally.

Your data and information submitted on our website is always encrypted between the web browser and the server to prevent unauthorized access to the information. However, no data transmission over the internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we make our reasonable best effort to ensure its security on our systems. As a general rule, we will not disclose any of your personally identifiable information, except when we have your permission, or under special circumstances such as when we believe in good faith that the law requires it.

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

All references to a “chargeback” refer to a reversal of a credit/debit card charge placed on the site. You agree that you will not chargeback any amounts charged to your credit/debit card. There is no reason for a chargeback to ever be filed. If a credit is due, simply contact us and we will gladly issue it. Unnecessary chargebacks are theft and can be prosecuted. If you feel that your credit/debit card was used fraudulently on our site, please contact us for immediate resolution. We may permanently suspend your account in the event of an unlawful credit card chargeback or payment dispute.

SATISFACTION GUARANTEE

We offer a thirty (30) day satisfaction guarantee. If you are not completely satisfied with your purchase, please submit a refund request by email within thirty (30) days after you receive your Graduation Package. Prior to the refund being processed, you must, at your own expense, return every item in your Graduation Package to us by a traceable shipping method. We will provide you with a shipping address promptly after we receive your request. A refund will be issued within approximately 72 hours from the acceptance of the returned Graduation Package. The refund amount will be the entire amount paid minus our shipping expenses. You hereby agree that after a refund is issued, your status as a graduate will be terminated from Stone Coast Academy. You certify that you will not use nor display any Stone Coast Academy documents, information, or products in any way or fashion and all the documentation awarded to you by Stone Coast Academy will be permanently deleted.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

THIS SITE AND ALL PROGRAMS AND SERVICES DELIVERED TO YOU THROUGH THE SITE ARE (EXCEPT AS EXPRESSLY STATED OTHERWISE) PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE ACCURACY, ADEQUECY, OR COMPLETENESS OF ANY SERVICE OR PROGRAM, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF OUR SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL CONTENT. INDEMNIFICATION

You agree to indemnify, defend, and hold us harmless, as well as our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from and against any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms, or your wrongful tortious conduct, intentional misconduct, your violation of any law or the rights of a third-party, or your use of the site.

NO WAIVER; ENTIRE AGREEMENT; ASSIGNMENT; SEVERABILITY

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us on this site or in respect to our services or programs constitutes the entire agreement and understanding between you and us and govern your use of our site, our programs, our products, and our services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these Terms). Any ambiguities in the interpretation of these Terms shall not be construed against us. We may assign these Terms at any time to any third party whom we choose in our discretion without your consent. In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, and any such determination shall not affect the validity and enforceability of any other remaining provisions.

GOVERNING LAW AND VENUE

These Terms and any separate agreements whereby we provide you our services, programs, or products shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to its conflict of law principles. Any dispute arising from or under these Terms or your use of the site, our services, programs, or products shall be submitted to the federal and states courts in Miami-Dade County, Florida, and you expressly agree that such courts shall have personal jurisdiction over you. In any dispute arising from or under these Terms or your use of the site, our services, programs, or products, the prevailing party shall be entitled to an award of reasonable attorney’s fees and legal costs against the non-prevailing party, from the inception of claim through and including all trial and appellate levels and collection of judgment proceedings.

We reserve the right, at our sole discretion, to update, change, modify, or replace all or any part of these Terms by posting updates and changes to our site. It is your responsibility to check our site periodically for changes.
